This Privacy Policy describes how ARKA Holdings & Investments, Inc. (“ARKA,” “we,” “us”) collects, uses, and shares information when you visit https://arkaholdings.ai, contact us through this site, or otherwise interact with ARKA materials. It does not cover information collected by third parties through their own properties or by tenants who operate compute hardware inside an ARKA facility.

We collect a limited set of information in three ways:

You give us

Name, email, organization, role, and the contents of any message you send through the contact form or briefing scheduler.

Collected automatically

Device, browser, referring URL, approximate location derived from IP, pages viewed, and timestamps. Used for site reliability and aggregate analytics.

From third parties

Calendar availability from our scheduling provider when you book a briefing, and information you choose to disclose through identity providers when accessing gated materials.

We use information to:

• Respond to inquiries and schedule briefings with qualified counterparties.
• Operate, secure, and improve the site and our communications.
• Send transactional messages related to a briefing or dataroom access you have requested.
• Maintain records required for compliance, audit, and lender diligence.
• Detect, prevent, and respond to misuse, fraud, or security incidents.

Where the EU or UK General Data Protection Regulation applies, we rely on the following lawful bases: performance of, or steps toward, a contract you have requested (briefings, dataroom access); our legitimate interests in operating, securing, and improving the site, provided those interests are not overridden by your rights; compliance with a legal obligation; and your consent for optional cookies and marketing communications.

We do not sell personal information. We share it only with:

• Service providers that host the site, deliver email, schedule briefings, and provide analytics, each bound by written confidentiality and data-protection terms.
• Professional advisors (legal, accounting, audit, lender counsel) under duty of confidentiality.
• Government, regulatory, or sovereign tribal authorities where required by law or sovereign compact.
• A successor entity in connection with a financing, restructuring, or business combination, subject to equivalent protections.

ARKA is based in the United States. If you contact us from outside the U.S., your information will be transferred to, stored, and processed in the U.S. and other jurisdictions where our service providers operate. Where required, we use Standard Contractual Clauses or equivalent safeguards.

We retain information only as long as needed to fulfill the purpose for which it was collected, to comply with legal, audit, and lender requirements, and to resolve disputes. Inquiry records are typically retained for the life of the related relationship plus a reasonable archival period.

Depending on where you live, you may have the right to access, correct, delete, or port your personal information; to object to or restrict certain processing; to withdraw consent; and to lodge a complaint with your supervisory authority. California residents have additional rights under the CCPA / CPRA, including the right to know and the right to opt out of any “sharing” for cross-context behavioral advertising (ARKA does not engage in such sharing).

We apply administrative, technical, and physical safeguards appropriate to the sensitivity of the information, including access controls, encryption in transit, and vendor diligence. No system is perfectly secure; we do not promise absolute security.

The site is intended for an institutional audience and is not directed to children under 16. We do not knowingly collect information from children.

We may update this policy as our practices or the law evolve. Material changes will be indicated by updating the effective date at the top of this page and, where appropriate, by an in-product notice.
